799 文件可能对郭先生的撤案带来什么帮助？ 一、政府的“故事”开始对不上了 在 799 文件中，郭先生指出几个核心问题： •政府说不清哪些钱是真正的犯罪收益； •大量资金属于投资人或第三方，并非郭先生个人； •陪审团已经判无罪的行为，却被政府“换个方式”继续惩罚。 这说明：问题不只是“罚多少钱”，而是案件本身是否站得住。 二、很多所谓“受害人”并不承认自己是受害人 更反常的是： •不少被政府称为“受害人”的人： •否认被骗； •反对政府没收； •认为损失来自政府查封，而不是郭先生。 这直接动摇了欺诈案件必须存在真实受害人的基础。 三、律师正在整理更严重的问题证据 目前，郭先生的律师团队还在进一步整理和核实证据，包括但不限于： •是否存在有人作伪证、假扮受害人出庭的问题； •是否涉及境外（包括中共相关人员）介入、操纵证人或证词的情况； •部分仍属机密的信息，一旦依法披露，可能直接影响案件是否合法、是否应当撤案。 这些内容一旦进入司法程序，将不再是“辩解”，而是程序正义问题。 四、“多重程序剥夺” → 过度惩罚与结构性不公 政府通过不同程序，对同一被告、同一资产进行重复性剥夺，却在刑事指控中假装这些剥夺不存在。 这为撤案请求提供了： •第五修正案正当程序； •第八修正案过度处罚（Excessive Fines）； •司法滥用（abuse of process）的事实基础。 五、799 文件本身不是撤案动议，但它的作用是： •把政府的漏洞、矛盾和程序问题固定在案卷里； •为撤案、部分撤销或上诉，提前铺好法律和事实基础； •让法院不能假装这些问题不存在。
郭先生刑事案件更新 799文件 针对破产令的异议 一、基本立场：郭先生不承认犯罪 •在没收程序中提及陪审团裁决，仅是程序性应对，并明确保留全部权利（包括上诉权），不构成对犯罪事实的承认。 二、Himalaya Exchange（喜马拉雅交易所）部分 •政府将大量HX账户资金直接认定为郭先生的“犯罪收益”。
重要提示‼️：七哥的刑事案和撤案申请是两条线同时进行的‼️刑事案的辩护有助于撤案申请的进行‼️ 七哥案件第799号法庭文件，是七哥律师2月3日提交法庭的推翻检方指控的重要文件。由于文件太长，这里只放首尾2页。 主要内容就是： 洗钱共谋定罪不能将陪审团认定为合法的GTV资金（4.87亿美元）纳入其中。 喜马拉雅交易所：6,512名账户持有人（约占三分之二）通过律师声明他们不是受害者，主张其经济损失源于政府查封行为而非郭文贵。 汉密尔顿基金：324名投资者主张其近9000万美元投资与指控的欺诈行为无关。 其他投资者：126名个人提交了权利主张申请，另有31封邮件表示否认受害者身份。 辩方引用Miller案和Rainford案判例，论证当投资者明确否认欺诈时，其投资不应计入没收总额。 破产托管人持有资产：根据"追溯"原则，政府对可没收资产拥有优先于破产债权人的权利，这些资产应用于抵扣没收金额。（要命了，被托管人花掉的7000万美元怎么办？能吐回来吗？） 根据Honeycutt案（2017年）判例，被告只能被要求没收其个人实际获得的资产。辩方指出，查获的资金存放于郭先生无正式角色的实体名下账户中，银行CEO柯林斯亦证实郭并非G Clubs等实体的实际受益人或控制人。 政府已持有资产如下： - 查封的银行账户现金：646,551,016.93美元 - SEC追缴款项：486,745,063美元 - 从哈立德处没收款项：2,700,000美元 合计：1,135,996,079.93美元 结论：辩护方请求法院： (1)拒绝13亿美元的金钱判决；或 (2) 如认定金钱判决适当，金额不应超过164,003,920.07美元（13亿减去已获得的约11.36亿美元），并应以出售其他特定财产的价值继续抵扣。 如果将托管人查封的2.4亿美元资产拿回来，则远大于1.64亿美元。等于整个欺诈案诈骗的资金小于零！这案子整的，怎么诈骗还贴钱了哈！ 其实这只是辩护的一部分，还有很多事项需要辩护，比如：315抓捕之前的取证过程，是否和中共国安有联系，取证是否合法；315之前的证人是否都出庭作证，证据是否经过法庭和陪审团验证；如果315之前的取证不合程序，是否属于先抓捕后取证；出庭证人声称是受害者，看看他们的投入和获得的财产，如果有明显的盈利，还能属于受害者吗？如果他们不属于受害者，是否属于伪证？证人和检方签署的协议能公开吗？检方在法庭上运用了郭先生的录音和直播，他们是怎么获得这些录音和直播的，如果他们听了郭先生的全部录音和直播，是否可以提供对郭先生有利的录音和直播？按法律规定，检方不能隐瞒对被告有利的证据；18楼的火灾到底是怎么引起的？丢了哪些东西？被谁拿走了？等等。 刑事案的取证指控和审理过程被层层扒开，刑事案和破产托管案的关系也逐渐浮出水面，这些都有利于撤案申请。美国的法律有个过程，但毕竟还是有法律的！我们静待花开！ #七哥案件 #三票先生 gettr.com/post/p3wyk22f9…

三票先生： 七哥刑事案789号文档。郭先生律师回应政府关于没收资产减免申请和第三方权利主张的立场。前面三页都是技术问题，精彩的在第四页： 1、“到目前，本案中受害者究竟是谁？实际遭受的损失的性质和数额为何？”这个涉及案件根基的问题到快量刑了，居然还没弄清楚。怪不得检方的几个版本的起诉书中“诈骗金额”有不一致的表述，也不精确，只说10亿美元以上。 2、“在破产程序中，受托人一直持有约2.4亿美元资产，这些资产理应属于本案所涉实体的投资者和客户，而非郭先生遗留资产......这些资产应当可用于退还或在适当情况下用于......索赔，而不应被受托人所产生的巨额开支耗尽......“。终于提到被破产庭冻结的2.4亿美元资产，以及受托人的巨额开支，这部分财产和开支终于可以拿到桌面上说了，冻结的财产部分好处理，关键是已经开支的部分怎么办？初步统计开支有约7000万美元之巨！乍弄呢？ 3、“某些所谓受害者可能根本不真实，而是受中共指使或影响的代理人”。七哥的律师既然在法律动议中明确这么说，就是有所准备的，很多中共的人要暴露了。看看检方是否还会提出债权人，这些债权人中是否有中共的代理人？ 不懂就问。既然受害者究竟是谁也没弄清楚，损失金额也不清楚，有些受害者是中共的代理人，我们很想知道检方在抓捕郭先生之前是怎么取证的（有证据才能抓捕）？这些取证程序是否合法？是否和中共有关？抓捕之前的证人是否都出庭作证了？如果出庭作证的证人都是抓捕后才取证的，是否属于先抓捕后取证？程序正义吗？ 4、七哥律师明确提出，中共国安人员在美国发起通过社交媒体和虚假信息对中共的反对者郭先生进行抹黑，“这些行动包括发布指称他（郭先生）是骗子、诈骗犯、把戏手、圈套者和诈骗者的指控”。这些是检方刻意回避的，陪审团对此也不知情，现在这些案件的重要背景都要拿到桌面上来讨论了。不懂就问，我们很想知道检方问什么要回避这些？ 5、七哥律师明确指出，喜交所的客户资金，不是由郭先生取得或占有，而是被政府非法查封并扣留。数字银行的资金也是如此。 现在案件逐步回到其本来的面目了，我们的很多疑问也将得到解答。既然这些事项都能在法庭公开提出来并开庭讨论，离真相大白的日子很近了！ 不懂就问，还有一个问题，为什么这些显而易见的事项，之前没有在法庭提出来，现在公开提了？大家仔细想想，这是为什么？ 稍安勿躁静待花开。 #七哥案件 gettr.com/post/p3wbf3xc1…

三票先生： 12月22日，法官就七哥刑事案量刑宣判延期一事做出判决，要点如下： 一、尽管检方反对，法官还是同意七哥的延期申请，从1月20日延期到4月13日，比七哥申请的延期三个月只少了一周，而且在检方的反对下，还是留了一个口子，届时如果有特殊充分理由，还是可以继续申请延期的。这是法庭依据宪法充分保护被告的基本权利。 二、检方一直声称要保护“第三方”权益，不同意被告延期宣判。依据法律，检方在今年8月11日法庭初步没收令下达后，就可以开展没收和赔偿工作。但是检方为什么不仅自己不做，还要说成是被告的延期在拖延？“第三方”究竟是哪些人？ 于是法官要求检方在1月9日前提交书面报告，要求检方解释没收资产的返还申请与权利主张的区别，检方解决各种索赔的方法。法院指定一名特别主事官就“第三方”索赔提出建议，检方对此有何看法。 原来法官也想知道检方一直声称的“第三方”究竟是哪些人，法官通过要求检方提交书面报告，最终要弄明白：“第三方”是谁，他们都提出了哪些申请，是否合理，检方将如何处置没收资产和赔偿。法官要任命一名特别主事官监督处理“第三方”索赔。这也是法庭依法保护被告权益，因为没收和赔偿资产的数量，和被告的量刑有直接关系。 这样，检方背后的“第三方”就要浮出水面，是否包括破产案的托管人？如果包括，托管人背后都代表哪些债权人？是否有中共的人混进来？托管人主张了哪些权益？这些权益主张是否合法？作为民事案的托管人是否扣押了2亿美元刑事案的资产？是否违反刑事案优先的原则？这些资产现在在哪里？其中有没有7000万美元已经被使用了？如何用的？这是否影响刑事案“受害人”的索赔权益？法官还要亲自安排人员监督“第三方”。这些都将在法官和七哥的讯问下曝光！曝光就好，一切都晒在阳光下，看看检方怎么提供书面答复。 三、由此可见，检方不仅希望法庭早点将七哥重判，还要在七哥被重判后主导没收财产的分配，满足检方认定的“第三方”的利益诉求，既关人又分财。如果七哥被重判，只能在漫长的上诉期间去维权。而七哥是既要在判决前证明自己无罪，又要保护战友财产。 四、本判决彰显了法庭和法律的公正，法庭依法充分维护检方和被告双方的权益，也厘清各方应该承担的责任，自己的锅自己背。 大家关注1月9日检方提交的书面报告，1月16日七哥的应答，1月20日法庭对双方提交文件的讨论。案件进入了深水区，峰回路转，我们有幸见证这一世纪大审判！ #七哥案件 gettr.com/post/p3vhxynad…
